        This is an agreement between you and Essex Heating Solutions Limited  (registered number 7699194).  Our registered address is Priory Place, Tiptree, Essex, CO5 0QE.

        By using our website, you acknowledge that you have read and agree to these terms. If you do not accept the terms, please do not use the website.  Your information will be saved for the purpose of sending out service reminders, to respond to queries or to send out estimates and invoices.

        We have the right to remove or stop supplying any product, service or function on our website at any time. It is your responsibility to read the terms and conditions regularly to ensure that you are aware of any changes.

        If you use the website after we have changed something, we will take this to mean that you have accepted the changed terms and conditions.

        Business terms and conditions

        When reading these terms us or we refers to Essex Heating Solutions also known as Essex Heating Services and you refers to the customer.

        You have requested us to carry out certain works for you and by agreeing for us to proceed is an indication of your agreement as set out.

        A quote is the expected charge for works that are based on initial assessments.  Please note that unforeseen circumstances may mean that a quote price may be reviewed.  You will be provided with a revised quote and have the right to decline or accept any revised quote.  Unless otherwise stated, our quote is based upon being able to complete the installation during our visit. If we are requested by the customer to carry out part works, we reserve the right to make an additional charge based upon the increase in labour undertaken. 

        Quotes whether written or oral, submitted by us shall be deemed to be an invitation to treat and not an offer. We will carry out only those items specified in the quote and shall not be responsible for works either promised or implied unless written into the quote or any amendment agreed to thereto in the written confirmation.  Our quote, unless specified, includes all necessary electrical work in connection with the work, with the exception of a power source for any immersion heater and cross bonding.

        All work specified will be carried out during normal working hours. Monday – Friday 8AM – 5PM . Where we are requested by you to carry works outside of the above, we reserve the right to make an additional charge.

        Where we are requested by you to undertake any additional work whilst on site you agree to pay our invoice for the work in full which will be charged on a time and material basis.
        Any appointments made are provisional and subject to change for operational reasons without notice. We cannot accept liability for any losses resulting from cancelled appointments where circumstances are beyond the control of the company.

        All estimates are valid for 28 days.

        Any changes to the work arising from you changing your mind or unforeseen circumstances will arise in a new or revised quote.  You have the right to accept or decline the new or revised quote.  If you decline the new quote, all work will cease and you will be liable for payment of any work already carried out in accordance with the original quote.

        In the event of cancellation by the customer, the company retains the right to claim reasonable costs.

        If you agree or insist on providing your own measurements for part or all of a job, you will be responsible for bearing the cost of any replacements of products or materials resulting in incorrect measurements.  This also applies to any products and or materials that you provide.

        You will notify us of any known or potential hazards before works are carried out.

        You will ensure that all the necessary permissions, licences and consent is obtained before works are carried out.  

        The responsibility to obtain any landlords and planning consent is yours.

        You grant us access to the agreed premises in order for us to carry out works.

        We will endeavour to complete all work within the timescale provided and we will comply with all the regulations and laws applicable.  However, any time or date quoted by us for delivery or collection of all or any of the goods or services is an estimate only and although we will do our utmost to ensure that any quoted time and date is met, it shall not be liable for any failure to meet any such estimate nor for any loss, whether financial or otherwise resulting directly or indirectly therefrom. Time is not and shall not be the essence in relation to this condition.

        We confirm that we hold valid and current Public Liability Insurance and Employers Liability Insurance where relevant.

        All materials and products supplied by us and used during the duration of the works shall remain the property of Essex Heating Services until the final invoices have been paid in full by you. 

        The security of any materials or tools on site whether fixed or not is the responsibility of the customer. We will strive to responsibly secure materials and tools but cannot be liable for blatant security flaws in your premises.

        Where the company undertakes flushing of the system, the work will be carried out on a best endeavours basis and no responsibility can be taken if further remedial work is found to be necessary. This includes any leak that shows itself due to pinhole or corrosion of pipe-work.

        Payment must be made to the engineer in full upon satisfactory completion,  unless an agreement has been entered into paying though BAC’s the payment at a later date.  Essex Heating Services reserves the right to charge interest at 3% above base rate currently in force, fortnightly on all outstanding accounts.

        Neither you nor us will be liable for any delays or failures to complete jobs as the result of any unforeseen and uncontrollable circumstances , including but not limited to an act of God and any other reason beyond the control of that party.

        We adhere to the Consumer Contracts (information, Cancellation and Additional Charges) Regulations 2013, except in the case of made to measure products or any bespoke products or materials that cannot be returned.

        Without prejudice to any rights and remedies available to
        it, whether under the Contract or otherwise, we shall be entitled, in our absolute
        discretion and upon giving you written notice of our intention to do so, either to
        terminate wholly or in part the Contract and/or
        any other contract with you or to withhold, vary or suspend performance of all or any of our obligations under the Contract or any other Contract in any one or more of the following events.

        •If any sum owing to us from you on any account whatsoever shall be unpaid after the date for payment.
        •If an insolvency Event occurs.
        •If you shall commit any breach of any Contract with us.
        •If we in good faith shall have doubts as to the solvency of you.

        If you refuse to permit or hinder performance of the Services of us, we shall be entitled to exercise our right of termination or suspension hereunder at any time during which the event giving rise thereto shall not have ceased or been remedied, and in the circumstances of any such suspension, we shall be entitled to require as a condition of resuming performance under the Contract, prepayment of or such security as it may stipulate for the payment of any sum or sums due to it. Upon any such event happening we shall have a general lien over all monies and property of your in its possession for any sums due to us.

        Essex Heating Services accepts no liability for any unavoidable damage caused to surrounding areas as a direct result of any work carried out on behalf of you who has been informed of the possible risks and has given their prior consent.  Any fragile or valuable objects or furniture must be safely removed by the customer prior to our arrival on site. Our engineers will move heavy items of furniture at the customer’s own responsibility. Breakage of glass or china etc. due to vibration is the responsibility of the customer. Whilst every care will be taken, the lifting and refitting of any flooring / carpeting is the sole responsibility of the customer. Please note for major works that are carried out there will be a degree of dust from core drilling and drilling operations. We will do our best to minimize any mess and will endeavour to leave the property in as clean and tidy condition as possible. However, Essex Heating Services cannot be held liable for any dust ingress.  All making good is included within our quotation except painting and decoration.

        Essex Heating Services will accept no responsibility for any existing components of a heating and hot water system which we assume to be in good working order.

        Essex Heating Services will remove all rubbish, scrap and surplus materials from site. An allowance has been made for any scrap metal which will become the property of the company.

        All works relating to the repairs carried out or parts used will be covered under the guarantee. Any new defects found not relating to the repair will be charged at our current rates.
